Solicitors (mostly debt collectors) are calling my number for the previous owner of my house. My number was never, ever the number for the previous owner, and I honestly have no idea where the callers are getting the number from. I have been telling the callers that they no longer live here, but the callers have recently become hostile and have told me that they just talked to someone earlier or they have records that the previous owner does actually live here. It is very frustrating. I am already on the "Do Not Call" list. Any suggestions?

tell them your on the do not call list, and record the names of hte business calling, if they keep calling, you can report it, and they can be fined and sued.

I would ask to speak to the supervisior on duty. I would also get the address of the collectors and write them a letter to let them know what is going on. Even though you are on the Do Not Call list, debt collectors are excluded from that list. Like I said your best bet is to talk to a supervisior on duty and let them know what is going on.

First, you should be able to identify the company by their caller ID if your phone is equipped with caller ID. Secondly, you must note the date of the call, the name of the telemarketer who called you and the city and state where the company is located. This information will help you to fill out a complaint form with the FTC and assist them with the investigation of a violator. Please go to the FTC website for complaint forms and instructions. You may also call their toll free number at 1-888-382-1222 for additional information. TTY users please call 1-866-290-4236 for further instructions.

Ask them to hold please, that you have something on the stove burning....and leave the phone for an hour or so. Trust me, they will quit calling you. Just keep repeating until they stop.

The "do not call" list does not apply to debt collection agencies or certain charities or anyone with whom you already have a business relationship. All you can do is ask for the complete name of the agency that is calling, and let them know that you have no business with them and demand that they stop calling. Send your demand in writing and suggest that they consult with an attorney to determine the propriety of calling, once they are on notice that the number is wrong. They are not doing it just to annoy you, they are trying to collect a debt. Once they learn that they will not be collecting the debt by calling your number, they will quit.

If this truely is not your debt then the next time they call you tell them you want their name, the name of their company, the mailing address and the surpervisory manager.
Once you have this information, send them a letter similiar to the following:
Date: [date of the letter]
Re: Acct # [the account number for which they are contacting you]
To Whom It May Concern:
This letter is being sent to you in response to repeated phone conversations you have initiated regarding the above account. As I do not recognize the debt in question, I am exercising my rights under the FDCPA to demand validation of the debt.
If this has already been reported to my credit report, I expect you to update the reporting to show that the debt is disputed, as required by law.
I look forward to working with you to resolve this issue and will be eagerly watching the mailbox for the validation I requested. I trust that you will have the documents mailed to me within 30 days of receiving this letter and will, of course, cease all collections actions until validation is provided.

Buy an answering machine and let every call go to the machine until the 30 days is up. Then, if they call again, file a complaint under FDCPA.
The FDCPA provides for a private right of action against violators. This means that you can get a lawyer and sue for damages. A partial list of damages that are awardable are:
Statutory damages up to $ 1,000 for each case. This means that the violator can be charged even though there are no other damages

They did a reverse address search which gave them your number. I would inform them that you are not the party they are searching for and you are on the do not call list and one more call you will begin reporting them. Get their name, note the date and time and start keeping track.

IF you have a cell phone, it gives you an opportunity to either answer or ignore a call. You my dear have been "hatched" by the collections companies in their stupid, mostly illegal activities. By the way, do you know what the Debt Collections Practice Act is all about? EACH time someone from a collections firm calls you and threatens you in any way or reveals information about the customer that walked out on his/her bills, both they and their company can be fined $ 10,000 AND spend as long as 5 years in jail!
IF you know the address of the firms that constantly call and harass you, you can put it in writing and save a copy. Make a subtle threat that you have included copies to you local Attorney General and to the Federal Trade Commission. Go after them as they have apparently gone after you!!
Your life is your own and you must never be afraid to pick up the telephone. Start learning about your rights - your ideology will turn around!

Call your phone company and tell them to put you on a do not call list OR make your phone privite and DO NOT give your phone number away, and of corse to put your phone privite you will have to change your number or it wont matter then...Well good luck and God Bless!!!
