I had a car accident a few months ago. I was stationary at red lights, and then the third party drove into the back of me. My car has been written off by my insurance company, the third parties car had no damage at all. The third party has told their insurance company that i "rolled back into her" but this is completely not the case. Her insurance company has done a engineers report and looked at her car and due to her car hardly having any damage except a few scratches they believe her!

At the time of the accident she was eager to settle without insurance companies willing to make me a cash payment but as I am insured and knew I was not at fault I thought it would be best to go through my insurance company.

Since the accident I have been experiencing pains in my neck and back. I am currently receiving physiotherapy and on pain killers. I have also claimed for whiplash.

What can I do?
