Can i claim compensation ?

9 months ago ,i had an accident at work . Being a carer, I lifted a client as there was no hoists and then pulled the muscle ( neck ) . Do u think im entitled to claim compensation? I know there are loads of website, which is the best one to use ?

I would consult a local personal injury attorney. I hope that you documented the injury at the time, or else it will be impossible to be compensated for it, because there will be no proof (which is your legal burden) that you were actually hurt at work.

Before getting involved, you need to answer a couple of questions:

Had you been given relevant health and safety training, including lifting techniques and limitations.

Was there a back-up person on call to help with difficult lifts.

If either of those is No, then you probably have a case.

However, you are not likely to get much in the way of compensation and it can take several years before judgement gets handed down. So will it be worth it!

My daughter in law claimed against her employer for compensation accruing from a lifting injury. Her injury is persistent and still gives problems some 6 years later.

It took 5 years for her to get an award of £800.00.

yes you can..you have one year from the date of injury. It would have been in your best interest though to file one right away, make sure you see your own physician you have that right, dont see the company's physician. This will all be under workers compensation law. Google your state laws on this..if you live in say..California.. google California worker's compensation laws and read the many different websites and make sure you save the sites to your favorites. Keep copies of everything, especially the incident report you will fill out and this is VERY important... give as much detailed information on the report, such as any witnesses, etc. And do not lie about anything it will blow your case, if they try to deny you benefits, get an attorney which might be the best thing to do if they do not want to help you through this and they might put up an arguement saying that you probably injured yourself doing something else but you could have aggravated the initial injury.
