can i claim back my application fee?

Hi, I applied for a private rented house 2 weeks ago to a letting agent. I paid the application fee and was awaiting the follow up on my references. Today i found out that the agent has already let the house last week even though i had already put in my application and paid the money. I called to find out what had gone wrong, if any of my references were not good enough or maybe failed the credit scoring etc, just to be told that someone else viewed the house 3 days ago and was able to pay upfront the fees, bond plus rent. I was sooooo angry as the agent told me that i had passed all the credit scoring and references and was just awaiting final confirmation from the landlord as to when i can move in but it was a case of first come, first serve. But i feel this is unfair as i was not warned other people were interested and have been in regular contact with the agent and it is not my fault that my employer decided to post my reference instead of emailing so it took 2 days to get a reference instead of same day. I asked the agent about getting my money back and he said they cant refund it as they spent it doing credit checks etc. Where do i stand? I am devastated as i have packed up everything ready to move, i have the rent and bond sat in my account and no where to move to. I don't even know if i can stay in my current home as i have given notice based on what the agent had told me last week........... any advice greatly appreciated. Thanks,

Realistically you have little chance of getting your money back - though this sounds grossly unfair. The best you can hope for is to find another place through the same agent. They should have been upfront with you and told you someone else could get in infront of you. Actually rereading it, the agent was a complete B******D. No wonder they and lawyers are regarded as the least trustworthy professions.
