just be cooperative. i wouldn't sign a waiver of medical ailments until you know for sure you're ok. sometimes people do that only to realize later that they're really hurt. sometimes, not always, but adjusters might push you to sign off on med. stuff before you get checked out good. see your doc.. and good luck.

The Workers' Compensation Division has representatives that can assist employers, employees, and insurance carriers. If you have questions or problems relating to a workers' compensation injury, call 1-800-332-2667 (within Tennessee) or 615/532-4812. If the representative cannot resolve the issues, a Workers' Compensation Specialist can assist in resolving disputes and settling claims at no cost to the employer or employee.
The role of the Representative is:
*To be the "first line of assistance" in cases with problems and/or disputes.
*To examine claims to insure accurate processing of benefits to injured employees.
*To advise employees and employers of rights and requirements under workers' compensation laws.
*To visit and consult with employers to verify coverage and compliance with safety requirements and to insure posting of the Tennessee Workers' Compensation Insurance Notice.
*To explain to all interested parties the laws, rules, and policies governing workers' compensation.
**A Workers' Compensation Specialist will also conduct a benefit review conference for all injuries occurring on or after January 1, 1997, that do not reach a final settlement and where the parties do not waive this requirement. Some Tennessee court jurisdictions already have this requirement.
**A benefit review conference is a non-adversarial mediation that takes place with the Specialist mediating the case between the employee and the employer/insurance carrier.

hold out as long as you can before settling. the longer you wait the more pressure is put on them to settle by their company. they are judged on how fast they settle claims when they go to raise their rates or for management to receive their bonuses
start high you can always go down , never up..

Without a doubt the best way to a big settlement is to hire a lawyer that works on contingency. (No money from you, he keeps usually 30% of your settlement).

Be fair and honest. Insurance adjusters are just people like you and they do not usually respond well to threats of lawyers, etc. That should be a last resort. They know the insurance laws and will use them to their advantage. As another answer said, do not sign or settle until you are sure of your injury. You should consult a lawyer for your protection but threats or lawsuits should be a last resort. If you cannot get satisfaction or fair treatment, then pursue through the courts. Million dollar settlements for being burned by a cup of coffee are few and far between so be realistic in your expectations......Or, if you can sleep at night, hire an ambulance chaser lawyer and sue for everything you can get.....All depends on your character.
