I met with a lawyer today for a car accident I was just in. The accident wasn't my fault. I have a neck sprain and he said he would settle with the insurance. However, he told me to go ahead and take the settlement that the insurance company would offer me (which won't be much). Why would he tell me to accept their offer when he's going to settle with them? I thought you did one or the other. I just want somebody to explain the reasoning behind it. My lawyer is also a "no win, no fee" lawyer. Thanks!

Accepting their offer is an acceptance of their offer to settle the case.

The insurance company makes an offer. When you accept their offer the case is settled.

You accepting the offer = settling. Only you - not your attorney - can settle with the insurance company.

Whiplash/neck sprain injuries are not exactly high-value case...hope you were not expecting much! No fee/no win is a common arrangement. But if you don't understand anything, your attorney should explain it until you do understand.

Your accepting an offer to settle the case.

The lawyer has to meet with the insurance company to come to an agreement. Thats what is called settlement. Then what is discussed and written up, is brought back to you to accept the settlement or not.

If you choose to accept, you just sign, and recieve whatever compensation there is
or
If you feel the settlement is not right and you deserve more, you dont sign and instruct your lawyer to do a better job.

Settlement is just the dealing in fine detail of what is to be expected by both parties.
It is only the end result when the both parties agree. You will be asked as to whether you agree to the settlement.
