I live in ca, where I got into a car accident that wasn't my fault. My friend was in da car and she is claiming back aches (which was a pre exisiting illness of hers) the insurance guy verified I had valid insurance b4 he paid out the injury claim. I am no longer claiming injuries, but my friend is. Would she have to have valid insurance for him to pay her for bodily injuries, since I am no longer pursuing my claim?

you and your passenger have 2 separate claims the insurance company is dealing with. Even though the insurance company has closed your claim, her claim is still open. I am confused about the fact they wanted to see your ins. prior to paying your claim, since the accident was not your fault???? Anyway, she is a passenger in the vehicle which does not require her to carry any insurance on your car.

No she would not be required to have a policy of her own in order to claim injuries. However if she is claiming an injury where there is a pre-existing injury then her claim in going to be severely reduced.

pre existing injuries are never covered. So regardless of whether of not she needs proof of insurance, the claim probably will not be covered. While you're not required to do so, most insurance companies want proof of other medical coverage. If your medical coverage will cover accident injuries then the adjuster will ask if you want to use your own medical insurance to pay for the medical bills and the insurance company will pay your co-pay or deductible. It's not required though. But your friend may not get much because her injury is pre-existing

No. If she was injured, she can file a claim against the at fault party. Just because you were not injured does not mean she was not. However, while she may think she is pulling a fast one, the claims adjuster will find out her back injury was pre-existing. Her claim will be evaluated and a reduction for prior the prior condition will be considered.
