I had a car accident this morning. A woman who was texting on her mobile went smashing into the back of me whilst I was in standing traffic. I got back pain so dialled 999 and the police and ambulance checked us over. She admitted fault.

However, I didnt take out legal cover this year on my car insurance (stupid I know) but as I got some painful injuries and needed to go to hospital, I feel like I want look into getting some compensation for this,

Could anyone tell me what the best step would be to find some legal assistance. How have people found compensation laywers / no win no fee groups? Can anyone recommend anything?

Thanks for any advice :)

What state are you residing in?

In California, if you do not have insurance, you will be held responsible.

Look in the yellow pages for personal injury attorneys and start calling them

It depends where you live.
In Michigan, we have "no fault" which means you carry to cover you.

If you are in Michigan and did not have insurance, Jennifer will be thanking you for a three year penalty, costing around one thousand dollars, plus the cost of fines-

I hope you are going to be ok and I hope you learned that insurance is important!

Your lacking insurance doesn't make you at fault, but you probably will have to pay a fine and face a suspension for it. For legal help, your Legal Aid Society may have some ideas, and there are lots of attorneys who will take a case "no win, no fee"--but if you win, as you should, they usually get 1/3.

First, though, see what her insurance company does. If they deny coverage or deal badly with you, you can consider suing.

No Fault states are AK, DE, DC, FL, HI, KS KY MA MD MI MN NJ NY ND OR PA SD TX UT WA. So if you live in one of these states, your own auto insurance needs to pay your medical bills first. Once that is exhausted you can submit to the liable party's insurance. Understand that if you submit these bills to your health insurance, and if they pay, they will want to be reimbursed by either your own auto ins or the liabile party's insurance.

Contact her auto insurance and set up a claim. Talk to the adjuster and tell them that you want them to pay your bills and some extra money for your pain and suffering. You do not need an attorney to do this. If you get an attorney you will owe them usually 33.5% of your settlement amount from the auto insurance. See if you can do it on your own. You won't get free help from an attorney, but if you are savvy you can do it on your own directly with the liability insurance.

UK reply

It sounds an open and shut case - other driver 100% at fault.

Any of the no win no fee ambulance chasers solicitors will take the case under these circumstances as they arer 99% certain to win. Beware though - some of them take 40% of your damages!

Check your house insurance as you may have some legal cover there.
Some bank current premium accounts also have some legal cover now.
Other than that no win no fee would be the way to go but you must keep your insurance company updated
